1 In the District Court, Grady County, Case No. CRF-73-16, appellant, George Edward Fred, hereinafter referred to as defendant, was charged and tried for the offense of Murder. He was convicted by a jury for the lesser included offense of Manslaughter in the First Degree, in violation of 21 O.S. 1971 § 711 [21-711]. His punishment was fixed at thirty-five (35) years imprisonment, and from said judgment and sentence he has perfected a timely appeal to this Court.
